Assault Charges in Connecticut

Written By CT Criminal Defense Lawyer, Attorney Tina Sypek D’Amato

Whether it’s road rage, bar fights, domestic violence, or assault on a police officer, usually incidents of assault are heat-of-the-moment crimes of passion. So, usually, they’re not premeditated. Assault is motivated by anger, not intellect, and usually leads to arrest either during or shortly after the incident.

For people charged with assault, there is usually a pattern or previous instance of this type of behavior in their past. Getting to the bottom of the destructive behavior and showing the judge that you take responsibility for your actions can help a prosecutor or judge give you a better offer. Showing you are getting help and are committed to making amends for your previous behavior, tells the judge with your actions that you do not intend to ever engage in this destructive behavior again. Getting therapy, getting sober, and going to a rehabilitation center, a 12-step program or the like, anger management. All of these are great ways to demonstrate that you are getting ahead of things.

Being truthful with me is essential for effective advocacy on your behalf. Often, charges of assault on a police officer arise from situations where the police initiated physical force, which escalated due to your natural instinct for self-defense. Claims that you interfered with an arrest are sometimes used to upgrade a misdemeanor to a felony. I have experience in federal cases against officers for excessive force and have seen video evidence where the police were the aggressors. To defend you effectively, I need accurate information and evidence. If you’re not honest with me, you’ll only hurt your own case—everyone in the courtroom will know the truth except me, and I won’t be able to provide the best defense.
